1. Agreement to Terms

These Terms of Use (“Terms”) constitute a legally binding agreement between you (“Member,” “you”) and Miloshevski Martial Arts LLC (“MMA,” “Company,” “we,” “us,” or “our”), governing your participation in our martial arts programs, use of our website (www.mmakaratedo.com), mobile apps, and related services (collectively, the “Services”), including membership management through Gymdesk.

By registering for or attending MMA classes or using the Site, you acknowledge that you have read, understood, and agreed to these Terms. If you do not agree, you must immediately discontinue use of the Services.

We may modify these Terms at our sole discretion at any time. Updates are effective upon posting on the Site. Your continued use of MMA services constitutes acceptance of the revised Terms.

2. Eligibility

  • Participants must be at least 3 years old for our karate programs.
  • Minors must have a parent or legal guardian complete registration and waivers through Gymdesk.
  • Adults must be at least 18 years old to register independently.

3. Assumption of Risk & Waiver of Liability

Participation in martial arts carries inherent risks, including physical injury, emotional injury, or property damage. By registering, you and/or your legal guardian acknowledge and agree that:

  1. You voluntarily assume all risks associated with MMA activities.
  2. MMA, its owners, instructors, and staff shall not be liable for any injury, loss, or damage sustained while participating, including travel to and from the facility.
  3. You consent to emergency medical treatment if deemed necessary.
  4. You agree to release, waive, discharge, and hold harmless MMA and its affiliates from any claims, lawsuits, or demands arising out of participation in classes, events, or seminars.

4. Membership & Class Policies

4.1 Membership Options

  • Unlimited Classes – Access to all classes across all locations.
  • 1 Class per Week – One class per week at a preferred location.
  • Drop-In – Pay-per-class option (higher rate applies).

Memberships are managed through Gymdesk, which handles:

  • Online registration and billing
  • Class schedules and attendance tracking
  • Account management

4.2 Billing & Renewal

 

  • Billing is based on your individual start date, not calendar months.
  • Memberships are billed monthly, 30 days in advance and auto-renew via Gymdesk until canceled.
  • You are responsible for ensuring cancellation requests are submitted before the next billing date.

4.3 Hold Policy

  • Membership may be placed on hold for up to 3 months (or 6 months for medical reasons) via Gymdesk.
  • A non-refundable holding fee applies for each month on hold.
  • This fee can be applied as credit toward a future membership; if unused, it is not refundable.

4.4 Cancellation Policy

  • Written notice of cancellation must be sent via Gymdesk or to [email protected] at least 48 hours before your next billing date.
  • Cancellations via verbal, SMS, or social media messages are not accepted.
  • MMA is not responsible for refunds after a payment has been processed, though store credit may be issued at MMA’s discretion.

5. Code of Conduct

Members must:

  • Follow instructor guidance and facility rules.
  • Refrain from inappropriate, violent, or disruptive behavior.
  • Respect other participants and MMA staff.

Failure to comply may result in suspension or termination of membership without refund.

6. Intellectual Property

  • All MMA content, including logos, lesson plans, instructional videos, and website materials, is owned by MMA.
  • Members may not copy, distribute, or reproduce materials without written permission.

7. Health & Safety

  • You must disclose any medical conditions that may affect participation.
  • MMA reserves the right to refuse participation if health risks are identified.
  • Proper attire, gear, and hygiene are required for all classes.

8. Gymdesk & Privacy

  • Membership accounts are maintained through Gymdesk, which stores personal data, billing information, attendance records, and class history.
  • MMA and Gymdesk follow strict privacy practices. Your personal data is protected in accordance with our MMA Privacy Policy, Gymdesk’s privacy policy and their Payment Security Protocols.
  • By registering, you consent to your personal information being collected, stored, and processed through Gymdesk for membership management, billing, and class tracking purposes.

9. Photo & Video Release

  • MMA may photograph or record classes, events, or seminars.
  • By participating, you grant MMA the right to use your image or video for promotional purposes without compensation.

10. Modifications & Interruptions

  • MMA may modify schedules, programs, or the Site at any time.
  • MMA is not liable for temporary interruptions or cancellations due to weather, maintenance, emergencies, or Gymdesk technical issues.

11. Governing Law & Dispute Resolution

  • These Terms are governed by the laws of the State of Illinois.
  • Any disputes shall be resolved exclusively in state or federal courts in Cook County, Illinois.
